V.<\/b>, with Tax Identification Number (CIF) F98829104 and registered office at C\/ JES\u00daS Y MAR\u00cdA, 19 BAJO DERECHA &#8211; 46008 \u2013 VALENCIA \u2013 SPAIN (hereinafter, CONTROLLER A).<\/p><p class=\"western\">On the other hand, <b>FORWARD 43 (The Gendered City)<\/b>, with registration number 81599994, BENELUXLAAN, UTRECHT, 3527HT \u2013 NETHERLANDS (hereinafter, CONTROLLER B).<\/p><p class=\"western\" align=\"CENTER\"><br \/><br \/><\/p><p class=\"western\" align=\"CENTER\"><b>RECITALS<\/b><\/p><p class=\"western\">That both Parties acknowledge having sufficient legal capacity to enter into this Agreement.<\/p><p class=\"western\">That CONTROLLER A and CONTROLLER B jointly determine the purposes and means outlined in this Agreement, as specified below.<\/p><p class=\"western\">That, in accordance with Article 26 of <b>Regulation (EU) 2016\/679<\/b>, of April 27, 2016, of the European Parliament and the Council, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR), and Article 29 of <b>Organic Law 3\/2018<\/b>, of December 5, on the Protection of Personal Data and the guarantee of digital rights (LOPDPGDD), both Parties agree to enter into this Agreement, which they expressly accept.<\/p><p class=\"western\" align=\"CENTER\"><b>SCOPE OF APPLICATION AND GENERAL CONDITIONS<\/b><\/p><p class=\"western\">CONTROLLER A and CONTROLLER B jointly determine the purposes and means necessary for the processing of personal data in the provision of mutual services, under which both controllers are committed to the following purposes:<\/p><ul><li><p class=\"western\">Sending information about the FEM.GREEN project and related activities, meeting calls, or sharing content of interest for its development.<\/p><\/li><li><p class=\"western\">Creating a database of individuals interested in projects related to urbanism, urban transition, and a feminist perspective, to subsequently send future communications, calls, or invitations to participate.<\/p><\/li><li><p class=\"western\">Identifying the participation of group members by publishing their professional contact details.<\/p><\/li><li><p class=\"western\">Each party retains ownership of the information provided by individuals who have indicated interest in the future work of one or both parties by ticking the relevant box.<\/p><\/li><\/ul><p class=\"western\">The controllers process the following personal data: identifying data, personal, professional, and contact information of the data subjects.<\/p><p class=\"western\">The purpose of this Agreement is to facilitate the determination of the joint controllers&#8217; responsibilities to comply with the obligations established in the current personal data protection regulations, particularly with respect to the exercise of the data subject&#8217;s rights and their respective obligations to provide information as referenced in Articles 13 and 14 of the GDPR.<\/p><p class=\"western\">The essential aspects of this Agreement will be made available to the data subject as provided in Articles 13 and 14 of the GDPR. The Parties may establish the essential terms separately through a privacy notice appended as an annex.<\/p><p class=\"western\">The Parties acknowledge that the data subject may exercise their rights, under the current data protection regulations, against each of the controllers.<\/p><p class=\"western\">The duration of this Agreement is indefinite, until the termination of the service.<\/p><p class=\"western\"><br \/><br \/><\/p><p class=\"western\" align=\"CENTER\"><b>RESPONSIBILITIES OF THE PARTIES<\/b><\/p><p class=\"western\">The responsibilities assigned to each Party are as follows:<\/p><table border=\"1\" width=\"642\" cellspacing=\"0\" cellpadding=\"7\"><tbody><tr valign=\"TOP\"><td width=\"433\" height=\"37\"><p class=\"western\" align=\"CENTER\"><span style=\"font-size: small;\"><b>Type of Responsibility<\/b><\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\"><span style=\"font-size: small;\"><b>Controller A<\/b><\/span><\/p><\/td><td width=\"82\"><p class=\"western\" align=\"CENTER\"><span style=\"font-size: small;\"><b>Controller B<\/b><\/span><\/p><\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"38\"><p class=\"western\"><span style=\"font-size: small;\">Providing data subjects with the information contained in Articles 13 and 14 of the GDPR<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"19\"><p class=\"western\"><span style=\"font-size: small;\">Serving as the point of contact for data subjects<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\">\u00a0<\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"19\"><p class=\"western\"><span style=\"font-size: small;\">Handling the exercise of rights by data subjects<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\">\u00a0<\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"19\"><p class=\"western\"><span style=\"font-size: small;\">Ensuring the security of personal data<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"19\"><p class=\"western\"><span style=\"font-size: small;\">Requesting and providing assistance to the other Party<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\">\u00a0<\/td><\/tr><tr valign=\"TOP\"><td width=\"433\" height=\"18\"><p class=\"western\"><span style=\"font-size: small;\">Ensuring the security of data transfers between both Parties<\/span><\/p><\/td><td width=\"83\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><td width=\"82\"><p class=\"western\" align=\"CENTER\">X<\/p><\/td><\/tr><\/tbody><\/table><p class=\"western\">In the event that any of the responsibilities outlined above is not explicitly assigned to the Parties, each Party shall assume them jointly and independently.<\/p><p class=\"western\">The Parties agree to ensure compliance with this Agreement by their data processors, employees, suppliers, and workers.<\/p><p class=\"western\">Notwithstanding the above, the Parties commit to mutual collaboration in accordance with the principles of diligence and good faith. They will also provide the other Party with assistance to ensure compliance with this Agreement, in accordance with current data protection regulations.<\/p><p class=\"western\"><br \/><br \/><\/p><p class=\"western\"><br \/><br \/><\/p><p class=\"western\" align=\"CENTER\"><b>FINAL PROVISIONS<\/b><\/p><p class=\"western\">This Agreement shall be governed in accordance with Spanish law, and the Parties shall mutually agree on the applicable jurisdiction in the event of a dispute.<\/p><p class=\"western\">The provisions herein supersede any prior agreements between the Parties, provided they have the same subject matter and scope of application.<\/p><p class=\"western\">This Agreement shall enter into force on the date it is signed by both Parties and shall remain in effect as long as it is adhered to, unless replaced by a different agreement signed by the Parties, which must comply with the current data protection regulations.<\/p><p class=\"western\">As evidence of their acceptance and agreement with each and every provision stipulated herein, committing themselves to fulfilling all agreed terms, the Parties sign this Agreement in duplicate in the place and on the date specified in the header of this document.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>JOINT CONTROLLERSHIP AGREEMENT FOR THE PROCESSING OF PERSONAL DATA In Val\u00e8ncia, on November 25, 2024 PARTIES On one hand, CREARQCI\u00d3, COOP.
